By accessing or using our services, including our website, mobile applications, and any other related services (collectively, "Services"), you agree to the following Terms of Service ("Terms"). By using SpeedVizion's Services, you agree to comply with and be bound by these Terms, our Privacy Policy, and any other policies or guidelines that may be posted on our website or provided to you. These Terms apply to all users, including both individuals and organizations ("Subscribers").

2. Use of Services

SpeedVizion provides video surveillance and data collection services that may include tracking vehicle speed and location within certain properties, including Homeowners Associations (HOAs) and other organizations. You agree that:

  • You will use the Services only for lawful purposes.
  • You will not attempt to access or manipulate data collected by SpeedVizion, except as authorized by the subscribing organization (e.g., HOA, business, etc.).
  • You will not interfere with or disrupt the integrity or performance of the Services.

3. Subscription and Account

To use certain features of SpeedVizion's Services, you may need to subscribe through an organization (e.g., HOA, business, or other entity). Subscribers are responsible for managing their accounts and ensuring that their personal and organizational details are accurate and up-to-date.

  • Organization's Role: As a Subscriber, the organization you belong to is responsible for managing data related to individuals under its membership, including access to collected vehicle data.
  • Account Security: You are responsible for safeguarding your account login information and ensuring that your account is used only by authorized individuals.

4. Surveillance Data Collection

SpeedVizion collects and processes vehicle-related data, including license plate numbers, speed, and timestamps from public areas. This data is used for:

  • Speed Monitoring: Ensuring compliance with speed limits.
  • Property Surveillance: Monitoring activity within the premises of the subscribing organization.

Data Access:

  • Only the subscribing organization (e.g., HOA, business) has access to personal data, including any association of license plates with vehicle owners. Individuals cannot access this data.
  • Vehicle owners may request exclusion from the database directly from the organization. It is the organization's responsibility to handle these requests.

5. Privacy and Data Handling

SpeedVizion is committed to protecting your data. By using our Services, you acknowledge that:

  • Data Collection: We collect information, including vehicle data and related metadata, which may include location data.
  • Data Use: The data we collect is used to monitor vehicle speeds, track trends, and improve our Services. Data may also be used by third parties with proper authorization for operational purposes (e.g., data analysis, improvements, etc.).
  • Data Sharing: We do not share personal data with third parties without explicit consent from the organization managing the data.
  • Data Retention: Data is retained for as long as necessary for business and legal purposes.

6. Service Availability

SpeedVizion's Services are not available to residents of the state of California. If you are located in California, you are not eligible to use our Services.

7. User Responsibilities

As a user of the SpeedVizion Services:

  • You must not use our Services to engage in illegal activities or violate others' rights.
  • You must not attempt to disrupt or hack our Services, or access unauthorized areas.
  • You must comply with all applicable laws regarding surveillance, data collection, and privacy rights in your jurisdiction.

8. Limitations of Liability

SpeedVizion will make reasonable efforts to ensure that the Services are functional and reliable, but we do not guarantee that the Services will be free of errors or interruptions. SpeedVizion is not liable for any damages arising from the use of our Services, including but not limited to:

  • Loss of data
  • Service interruptions
  • Security breaches

9. Indemnification

You agree to indemnify and hold SpeedVizion, its affiliates, and partners harmless from any claims, liabilities, or damages arising from:

  • Your use of our Services.
  • Your violation of these Terms or any applicable law.
  • Your actions that cause harm to SpeedVizion, its users, or third parties.

10. Changes to the Terms

SpeedVizion reserves the right to update, modify, or change these Terms at any time. Any updates will be posted on this page with an updated "Effective Date". Your continued use of our Services after such updates constitutes your acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Services, at our discretion, if we believe you have violated these Terms. Upon termination, you must cease using the Services and, if applicable, delete any data obtained through our Services.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which SpeedVizion operates, without regard to its conflict of law principles. Any disputes shall be resolved in the appropriate court within the jurisdiction where SpeedVizion is registered.
